Crime Ambiental Praticado por Pessoa Jurídica: Condenação da Empresa A. Gurgel do Carmo & Cia Ltda por Crime Contra o Meio Ambiente no Estado do Amazonas

Abstract

The research analyzes the environmental crime committed by a legal entity, resulting in the conviction of the company A. Gurgel do Carmo & Cia Ltda. for environmental offenses in the State of Amazonas, under Law No. 9,605/1998. The study discusses the possibility of penalizing legal entities, examining the Legal Fiction Theory and the Reality Theory, and highlights the criminal conduct of the company in light of environmental damage, supported by doctrine and jurisprudence. It concludes that legal entities can indeed be convicted, regardless of the accountability of their directors.
